Terms of Service

1. Acceptance of Terms
By accessing or using Metro Rail Guru L&E Monitoring System ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Metro Rail Guru provides a cloud-based Lift & Escalator monitoring, fault management, and preventive maintenance scheduling platform for metro rail organisations. The Service includes web application access, mobile PWA access, data storage, reporting tools, and customer support.
3. Subscription and Payment
Plans: The Service is offered on a subscription basis. Available plans (Starter, Professional, Enterprise) are described on our Pricing page.
Billing: Subscriptions are billed monthly or annually in advance. All prices are in INR and exclusive of applicable taxes (GST).
Auto-renewal: Subscriptions automatically renew unless cancelled at least 7 days before the renewal date.
Refunds: Monthly subscriptions are non-refundable. Annual subscriptions may receive a pro-rated refund for unused months if cancelled within 30 days of payment.
4. Authorised Use
You may use the Service only for legitimate metro rail operational purposes. You agree not to:
- Share login credentials between multiple individuals
- Attempt to reverse engineer, copy, or resell the Service
- Upload malicious content or attempt to breach security
- Use the Service to store data unrelated to L&E operations
- Exceed the equipment or user limits of your plan
5. Data Ownership
You retain full ownership of all operational data (fault records, equipment lists, maintenance logs, reports) that your organisation enters into the Service. We do not claim any rights to your operational data.
You grant us a limited licence to store, process, and display your data solely for the purpose of providing the Service.
6. Availability and Uptime
We strive to maintain 99.9% uptime for Professional and Enterprise plans. Planned maintenance will be communicated at least 24 hours in advance. Downtime caused by factors outside our control (internet outages, force majeure) is excluded from uptime calculations.
7. Limitation of Liability
The Service is provided for operational support purposes. Metro Rail Guru shall not be liable for:
- Any operational decisions made based on data in the Service
- Equipment failures not reported through the Service
- Data loss due to user error or misuse
- Indirect, incidental, or consequential damages
Our maximum liability shall not exceed the subscription fees paid in the preceding 3 months.
8. Intellectual Property
All rights to the Metro Rail Guru software, design, taxonomy structures, algorithms, and branding remain the exclusive property of Metro Rail Guru. No part of the Service may be copied, modified, or distributed without written permission.
9. Termination
Either party may terminate the subscription with 30 days written notice. Upon termination, you will have 90 days to export your data. After 90 days, data will be permanently deleted.
We reserve the right to immediately suspend access for violation of these Terms.
10. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, India.
